SHARED REPLACEMENT POLICY

UBACARE and the Client agree to share in the costs of replacing orders dispensed and shipped by UBACARE on behalf of the Client.   This replacement policy is an understanding and not an insurance policy, a warranty, a solution for buyer’s remorse, or a substitute for buyer diligence (i.e., pre-purchase research and inspection).  The terms and conditions associated with protecting the Client’s member against loss, theft, and damage of goods dispensed and shipped by UBACARE are the as follows:

Shared replacement policy will only apply to completed transactions between UBACARE and the Client.

  • If a plan member or the Client reports that an order that has been shipped by UBACARE exhibits signs of deliberate tampering, UBACARE must immediately advise the member to dispose of the medication by an environmentally safe and industry endorsed means.  UBACARE will immediately dispense and ship a replacement order to the Client’s member.  UBACARE and the Client will equally share in the replacement cost of the drug and shipping and handling fees associated with the replacement order.
  • If a plan member’s order has been inspected and opened by a government and/or regulatory agencies such as the Food and Drug Administration (FDA), U.S. Customs and Border Protection, and Homeland Security, the replacement policy will not apply.
  • If a plan member’s order has been inspected and confiscated by personnel of the United States Customs and Border Patrol or the FDA (Food and Drug Administration), the replacement policy and cost sharing will apply.
  • If a plan member or the Client reports to UBACARE that there has been no attempted delivery by the carrier confirmed by tracking data after 30 days, the order will be considered lost.  UBACARE will immediately dispense and ship a replacement order to the Client’s member.  UBACARE and the Client will equally share in the replacement cost of the drug and shipping and handling fees associated with the replacement order.
  • Any temperature-sensitive medications that experience a break in the cold chain and would be considered unsafe and/or ineffective based on the interpretation of published and non-published stability data provided by the licensed manufacturer.  UBACARE and the Client will equally share in the replacement cost of the item(s) and shipping fees associated with the replacement order.
  • UBACARE will assume no fiscal responsibility for all orders that are not received by an individual plan member where an attempted delivery has been made to the correct shipping address. The individual plan members are responsible for tracking, receiving and/or picking up their respective orders as indicated in the attempted delivery slip.
  • If an order has been delivered to the incorrect address by the carrier.  UBACARE and the Client will equally share in the replacement cost of the item(s) and shopping fees associated with the replacement order.
  • UBACARE is responsible for informing Health Canada if and when they commence a recall of a drug product from sale or further distribution.  UBACARE is responsible for submitting information specified in Section C. 01.051 of the FDR to Health Canada within 24 hours of having made the decision to recall.  UBACARE will advise the Client of the nature of the product recall and steps taken.  UBACARE will not be fiscally responsible for the dispensing and shipping of a new replacement order.
  • The maximum replacement cost for any given order is Five Thousand ($5,000 USD) per single parcel.
  • From a general perspective, no medications should be shipped between December 5th and January 15th because of seasonal pressures on the postal services.  Any orders at other times of the year that are shipped under conditions that could be categorized as Force Majeure will not be covered by the replacement policy.

Exceptions

  • Any orders that have been dispensed or shipped in error (incorrect quality, quantity, strength of drug, type of drug, incorrect shipping address) will be replaced at UBACARE’s sole expense immediately.  Any dispensing error must be reported to UBACARE within three (3) business days of receiving the goods to qualify for a replacement order to be dispensed and shipped to the Client’s member at no cost to the Client.
  • Any orders that have been dispensed and/or shipped in error due to a communication error on the part of the Client and/or Client’s member (incorrect shipping address) will be replaced by UBACARE. The Client will be charged only the full price of the item(s) including the shipping cost to ship a replacement order to the Client’s member.
  • The shared replacement policy is not applicable, whatsoever, if and when the best and efficient shipping method is not selected by the Client on behalf of its plan member.
  • Temperature-sensitive medications that cannot tolerate any temperature excursion.

How to Request a Replacement Order

Requesting a replacement order under the shared replacement policy, requires the Client to submit a replacement request no later than three (3) days upon the order being successfully delivered or thirty-five (35) days after the original shipping data for goods that have not been delivered successfully to the Client’s member.  The Client or plan member is required to present all qualifying and appropriate information to substantiate such request by providing explicit details associated with the order (i.e., picture of damages/defects, evidence of non-delivery).  UBACARE will verify and confirm the eligibility of “replacement” of an order, within two (2) business days of receiving a request.

Termination and/or Amendment

The Terms and Conditions of the Shared Replacement Policy, may be modified, changed, or terminated by UBACARE without notice.
